Terms of Service
Last updated October 28, 2026
These Terms of Service ("Terms") are a binding agreement between you and List AI ("List AI", "we", "us"). They cover your use of list-ai.io, the List AI platform, our AI agents, and any related services (together, the "Service"). By creating an account, joining the waitlist or using the Service, you agree to these Terms. If you use the Service for a company, you confirm you have authority to bind that company, and "you" means the company.
You are responsible for who you message.
List AI is a tool. You decide who gets contacted, what is sent and when. You must have proper consent before any call, text or email goes out. If you message people who did not opt in, or break any messaging law, that is your legal responsibility, not ours.
1. The Service
In plain words: We give you software that helps you follow up with and book your leads. We may improve or change it over time.
List AI provides AI-powered software for real estate professionals, including AI calling, texting and email, lead routing, calendars, inboxes, reporting and an AI assistant ("Lex").
We may add, change or remove features at any time. Some features may be in beta, which means they may be unfinished, change without notice or be removed. Beta features are provided as-is.
Parts of the Service rely on third-party providers, such as phone carriers, messaging and email providers, AI model providers, calendar services and hosting providers. Their availability and rules are outside our control.
2. Your account
In plain words: Keep your login safe. You are responsible for everything done in your account, including by your team.
You must be at least 18 years old and able to form a binding contract to use the Service.
You must give us accurate information and keep it up to date. You are responsible for keeping your login details secure and for all activity in your account, including activity by team members, agents and anyone else you give access to.
Tell us right away at support@list-ai.io if you think your account has been accessed without permission.
3. Messaging, consent and compliance
In plain words: Only contact people who agreed to hear from you. You, not List AI, are the sender of every message and responsible for following the law.
You are the sender of every call, text message, email and other communication made through the Service ("Communications"), even when the Service writes or sends it automatically using AI. List AI acts only as a technology provider on your instructions. You decide who is contacted, what is said and when.
You are solely responsible for making sure every Communication complies with all laws, regulations and carrier rules that apply to you and the people you contact. These include, for example:
- The Telephone Consumer Protection Act (TCPA) and FCC rules, including rules on autodialed, prerecorded and artificial or AI-generated voice calls and texts.
- The National Do Not Call Registry, state do-not-call lists and your own internal do-not-call list.
- State telemarketing and "mini-TCPA" laws, including quiet hours and call frequency limits.
- The CAN-SPAM Act and other email marketing laws.
- Canada's Anti-Spam Legislation (CASL), the CRTC Unsolicited Telecommunications Rules and the National Do Not Call List (DNCL).
- Privacy laws in the United States and Canada, including state consumer privacy laws (such as the CCPA/CPRA), PIPEDA, Quebec's Law 25 and provincial privacy laws in Alberta and British Columbia.
- Call recording and wiretap laws, including states that require all parties to agree before a call is recorded.
- Mobile carrier rules and industry guidelines, including A2P 10DLC registration requirements and the CTIA Messaging Principles.
- Fair housing, real estate licensing and advertising laws.
Before any Communication is sent, you must have the right level of consent from each person (for example, prior express written consent where the law requires it), and you must keep records that prove it. You must honour opt-out requests (such as STOP) promptly and must not contact anyone who has opted out.
You must not upload, import or message purchased, rented, scraped or harvested contact lists, or any list where you cannot prove consent.
Compliance tools in the Service, such as opt-out handling, quiet hours, do-not-call checks and approval modes, are there to help you. They do not guarantee compliance, may not cover every law or situation, and do not move responsibility to List AI. You remain fully responsible for your Communications.
List AI is not responsible or liable for any Communication you send or cause to be sent, or for any claim, fine, penalty, carrier block or loss that results from it, including messages sent to people who did not opt in.
4. AI features
In plain words: Our AI does its best, but it can make mistakes. Check what matters, and use approve mode if you want to review messages first.
The Service uses artificial intelligence to write messages, hold conversations, make calls, score leads, summarise information and suggest actions. AI output can be wrong, incomplete or inappropriate, and may not reflect your views or the facts.
You are responsible for how you set up, train and use the AI, including the information, scripts and instructions you give it, and for reviewing its output where accuracy matters. You can require approval before messages are sent.
You must make sure the AI does not give legal, financial, tax or other professional advice on your behalf, and that it does not make promises you cannot keep. Where the law requires it, you must tell people they are talking to an AI or to an automated system.
AI output is not professional advice from us. Nothing produced by the Service is legal advice.
5. Acceptable use
In plain words: Don't use List AI to spam, scam, harass, discriminate or break the law, and don't try to break or copy the platform.
You agree not to use the Service to:
- Send spam, unsolicited messages or messages to people who have not consented.
- Mislead, deceive, threaten, harass or abuse anyone, or impersonate any person or business.
- Discriminate against anyone in breach of fair housing or other laws.
- Send content that is illegal, hateful, sexually explicit or that infringes anyone's rights.
- Collect sensitive information you are not allowed to collect, such as full payment card numbers or government ID numbers, through messages.
- Get around carrier filtering, sending limits, opt-outs or our safety controls.
- Hack, overload, reverse engineer, copy or resell the Service, or access it by automated means we have not approved.
We may review, pause or block Communications, phone numbers or accounts at any time if we believe they break these Terms, the law or carrier rules, or put us, our providers or others at risk.
6. Your data
In plain words: Your contacts and data belong to you. We never sell them, rent them or give them to another company. We only use them to run List AI for you.
We do not sell, rent, trade or license Your Data, or any personal information in it, to anyone. We do not use your contacts to market to them ourselves, and we do not share them with other List AI customers. Your Data is your confidential, proprietary information.
You keep ownership of the data and content you put into the Service, including contacts, conversations, notes and files ("Your Data"). You give us permission to host, process, copy and use Your Data only as needed to provide, secure, support and improve the Service.
You confirm you have the right to give us Your Data, including any personal information about your leads and clients, and that you have given any notices and received any consents the law requires for us to process it.
We may use data that has been de-identified and combined so it no longer identifies you or any person, to measure and improve the Service.
How we handle personal information is explained in our Privacy Policy.
7. Fees and payment
In plain words: You pay the agreed price for your plan. Usage like calls and texts may cost extra.
You agree to pay the fees for your plan and any usage-based charges (such as call minutes, text messages, phone numbers and carrier fees) as shown at sign-up or in your order. Fees do not include taxes, which you are responsible for.
Unless we agree otherwise in writing, subscriptions renew automatically and fees are non-refundable. We may change our prices with notice; changes apply from your next billing period.
If payment fails, we may pause or limit your access until it is paid.
8. Our intellectual property
In plain words: The platform, brand and software belong to List AI. You get to use them while your account is active.
The Service, including its software, design, AI agents, text, graphics and the List AI name and logo, belongs to List AI and its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service for your business while your account is active and you follow these Terms.
If you send us ideas or feedback, we may use them freely without owing you anything.
9. Third-party services
In plain words: Tools you connect to List AI have their own rules. We aren't responsible for them.
The Service may connect to third-party products, such as your existing CRM, calendar, email, ad accounts, lead sources and phone carriers. Your use of them is governed by their own terms. We are not responsible for third-party services, their availability, or any data they lose or change.
10. No guarantees
In plain words: We work hard to make List AI great, but we can't promise specific results like more deals or revenue.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, LIST AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
We do not promise that the Service will be uninterrupted, error-free or secure, that messages or calls will be delivered, or that you will get any particular result. Results, figures and client stories shown on our website are examples from individual clients and are not a guarantee of your results.
11. Limits on our liability
In plain words: If something goes wrong, our responsibility is capped at what you paid us in the last 12 months.
TO THE FULLEST EXTENT ALLOWED BY LAW, LIST AI AND ITS OWNERS, EMPLOYEES, CONTRACTORS AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DEALS, COMMISSIONS, DATA OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
LIST AI WILL NOT BE LIABLE FOR ANY CLAIM, FINE, PENALTY OR LOSS ARISING FROM COMMUNICATIONS YOU SEND OR CAUSE TO BE SENT THROUGH THE SERVICE, INCLUDING CLAIMS UNDER THE TCPA, US OR CANADIAN DO-NOT-CALL RULES, CAN-SPAM, CASL, PRIVACY LAWS OR CALL RECORDING LAWS.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, OR US $100 IF YOU HAVE NOT PAID US ANYTHING.
Some places do not allow certain limits, so some of these may not apply to you.
12. You cover us for your actions
In plain words: If someone takes legal action against List AI because of messages you sent or how you used the platform, you cover the costs.
You agree to defend, indemnify and hold harmless List AI and its owners, employees, contractors and providers from and against any claims, lawsuits, regulatory actions, fines, penalties, damages, losses and costs (including reasonable legal fees) arising from or related to:
- Any Communication sent through your account, including any claim that a person did not consent, opted out, was on a do-not-call list, or was contacted at the wrong time.
- Your Data, including any claim that you did not have the right to collect or use it.
- Your use of the Service, including how you set up and instructed the AI.
- Your breach of these Terms or of any law, regulation or carrier rule.
- Any dispute between you and your leads, clients, team members or other third parties.
13. Ending your account
In plain words: You can leave any time. We can suspend or close accounts that break these Terms.
You can stop using the Service and cancel your plan at any time; cancellation takes effect at the end of your current billing period.
We may suspend or end your access immediately if you break these Terms, create legal or carrier risk, fail to pay, or if required by law or a provider.
After your account ends, you can ask us to export Your Data within 30 days. After that we may delete it. Sections that by their nature should continue (such as payment owed, ownership, disclaimers, liability limits and indemnity) survive after the account ends.
14. Disputes
In plain words: Talk to us first. If we can't fix it, disputes are settled one-to-one by arbitration, not class actions.
If you have a problem, contact us first at support@list-ai.io and we will try to resolve it informally within 30 days.
If we cannot, any dispute will be resolved by binding individual arbitration, except that either side may bring a qualifying claim in small claims court, and either side may seek an injunction to protect intellectual property. You and we each give up the right to a jury trial and to take part in a class action or class arbitration.
These Terms are governed by the laws of the jurisdiction where List AI is incorporated, without regard to conflict-of-law rules.
15. General
In plain words: Standard legal housekeeping: we may update these Terms, and this is the full agreement between us.
We may update these Terms from time to time. If a change is significant, we will tell you by email or in the Service before it takes effect. Using the Service after that means you accept the updated Terms.
These Terms, together with any order form and our Privacy Policy, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
